Terms of Service

These Terms of Service ("Terms") govern your access to and use of Theatreview — including our website, mobile applications, and related services (collectively, the "Service") — operated by One More Byte LLC, a limited liability company organized in the State of Minnesota ("Theatreview," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you are at least 13 and that you have the legal capacity to enter into these Terms. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian.
2. The Service
Theatreview lets you log, rate, and review live performances — including the specific cast you saw — keep a theatregoing diary, and follow other users. We may change, add, or remove features, and may suspend or discontinue the Service (in whole or in part) at any time. Certain features may be offered on a waitlist or early-access basis before general availability.
3. Your Account
To use certain features you must create an account, which you may do with an email and password or through a third-party sign-in provider such as Apple or Google. You agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
4. User Content
"User Content" means anything you submit to the Service, such as reviews, ratings, notes, lists, and profile information. You retain ownership of your User Content.
By submitting User Content, you grant Theatreview a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content solely as needed to operate, provide, and improve the Service. This license ends when you delete your User Content or account, except for content others have shared or copies retained as required by law or for backup purposes.
You represent that you own or have the necessary rights to your User Content and that it does not violate these Terms or any law.
5. Acceptable Use
You agree not to:
- Post content that is unlawful, defamatory, harassing, hateful, infringing, or otherwise objectionable;
- Impersonate any person or misrepresent your affiliation;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with or disrupt the Service, or introduce malware;
- Scrape, harvest, or collect data from the Service except as expressly permitted; or
- Use the Service in violation of any applicable law or regulation.
We may remove content or suspend or terminate accounts that violate these Terms, at our discretion.
6. Intellectual Property
The Service, including its software, design, text, graphics, logos, and the "Theatreview" name and marks, is owned by One More Byte LLC or its licensors and is protected by intellectual property laws. Except for your User Content and rights expressly granted to you, we reserve all rights. You may not copy, modify, or create derivative works from the Service without our permission.
7. Third-Party Services
The Service relies on and may link to third-party services and platforms, including app stores and sign-in and infrastructure providers. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content is accurate or reliable.
9. Limitation of Liability
To the maximum extent permitted by law, One More Byte LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars ($50).
10. Indemnification
You agree to indemnify and hold harmless One More Byte LLC and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms or any law or third-party right.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
12. Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Minnesota, unless otherwise required by applicable law.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after any change constitutes acceptance of the updated Terms.
